The Living Room Coworking, S.L.U. owns the intellectual and industrial property rights regarding the brands, brand names or distinctive signs. The access to the portal does not imply any type of right over the aforementioned brands, brand names and/or distinctive signs.

All products and services of these websites which ARE NOT property of The Living Room Coworking, S.L.U., are registered trademarks by their respective owners and they are recognised as such for our company. They only appear on the website of The Living Room Coworking, S.L.U. for promotional and information purposes. The owners of such information can request this information to be modified or deleted.

3. Terms of use of the portal

3.1 General conditions

The user agrees to use this portal in accordance with the current applicable regulations and with this legal notice. The user will take responsibility before The Living Room Coworking, S.L.U. or a third party for any damage caused by the breach of that obligation.

• Extracting and/or reusing entirely or a substantial part of the portal’s content, as well as the databases that The Living Room Coworking, S.L.U. puts at the users’ disposal.

3.3 Referring links to the portal

The internet users who want to refer links to the portal from their own webpages, must fulfill the conditions detailed below. The ignorance of these conditions does not avoid legal responsibilities:

4. Disclaimer

4.1 Information

The Living Room Coworking, S.L.U. is not responsible for the decisions taken based on the information provided on the portal nor the damages produced to the user or third-parties because of actions having as their sole basis the information obtained from the portal.

4.2 Quality of service

The access to the portal does not imply any obligation on part of The Living Room Coworking, S.L.U. to control the absence of viruses, computer worms or any other harmful IT elements. The user is, in any case, responsible for having suitable antivirus tools installed to detect and repair malware. 

The Living Room Coworking, S.L.U. will not be held responsible for damages produced on the users’ or third-parties’ hardware during the use of the portal.

4.3 Availability of the service.

The access to the portal requires third-party services, including the transmission by telecommunication networks whose reliability, quality, continuity and functioning is not the responsibility of The Living Room Coworking, S.L.U. Therefore, the services provided on the portal can be interrupted, canceled or unavailable at any point of time. 

The Living Room Coworking, S.L.U. takes no responsibility for any kind of damages caused to the user by failures or disconnection in telecommunication networks which cause the interruption, cancellation or suspension of the portal at any point of time.

4.4 Content and services linked to by the portal

The access to the portal includes technical linking devices, directories and search tools that allow the user to access other websites and portals (hereinafter, “referred websites”). In these cases, The Living Room Coworking, S.L.U. acts as a provider of intermediation services in accordance with article 17 of the Law 34/2002 from July, 12th (Servicios de la Sociedad de la Información y el Comercio Electrónico, also known as LSSI), and will only be responsible for the content and services provided on the referred websites insofar as it has real knowledge of the illicitness and does not deactivate the link with due diligence. In the event that the user considers a referring website to contain illicit or inappropriate content, he/she can notify the The Living Room Coworking, S.L in accordance with the procedure and the effects established in clause 6, without this communication implying in any case the obligation to remove the link.

In no case, the existence of referred websites must presuppose the existence of agreements with the owner or person in charge of these websites, nor the recommendation, promotion or identification of The Living Room Coworking, S.L.U. with the statements, content or services provided.

The Living Room Coworking, S.L.U. does not know all content and services of referred websites and, therefore, it does not take responsibility for the damages caused if the content and/or services of those websites are illicit, of bad quality, out-of-date, unavailable, wrong or useless, nor for any other damage that it is not directly attributable to The Living Room Coworking, S.L.U.

6. Notification of illicit or inappropriate activities

Should the user or any other Internet user have knowledge that the referred websites refer to websites whose content or services are illicit, harmful, insulting, violent or immoral, the user can contact The Living Room Coworking, S.L.U. indicating the following details: 

1. Personal data of the user: name, address, telephone number and email address;
2. Description of the facts that reveal the illicit or inappropriate nature of the referred website;
3. In case of infringement of rights, such as intellectual and industrial property, the personal details of the owner of these rights in case they belong to a person who is not the user. 
4. Additionally, the title deed must be provided showing proof of the legitimate rights ownership and, if applicable, the power of attorney to act for the owner when it is a different person than the user;
5. Explicit declaration that the information contained in the claim is correct.

The reception by The Living Room Coworking, S.L.U. of the required notification mentioned earlier in this clause, will not mean, according to the LSSI, the real knowledge of the activities and/or content indicated by the user.

Additionally, the title deed must be provided showing proof of the legitimate rights ownership and, if applicable, the power of attorney to act for the owner when it is a different person than the user; explicit declaration that the information contained in the claim is correct.

7. Notifications

All the notifications and communications carried out by the parties will be valid in accordance with the means accepted by the law. The notifications and communications related to this portal will be considered effective, to all intents and purposes, if they are carried out via the portal.

The Living Room Coworking, S.L.U. reserves the right to carry out, without notice, changes on its website that it considers opportune. The company can change, delete or add comments and services provided through the website, as well as the way in which these are displayed.

10. Applicable Law

This legal notice shall be governed by Spanish legislation if and when the applicable law allows to renounce the established legal jurisdiction, the designated court of jurisdiction to resolve any possible disputes is the court of Málaga, explicitly renouncing any other jurisdiction that could correspond to the user.

3. Condiciones de uso del portal

3.1 General

4. Exclusión de responsabilidad

4.1 De la información

The Living Room Coworking, S.L.U. no se responsabiliza de las decisiones tomadas a partir de la información suministrada en el portal ni de los daños y perjuicios producidos en el usuario o terceros con motivo de actuaciones que tengan como único fundamento la información obtenida en el portal.

4.2 De la calidad del servicio

El acceso al portal no implica la obligación por parte de The Living Room Coworking, S.L.U. de controlar la ausencia de virus, gusanos o cualquier otro elemento informático dañino. Corresponde al usuario, en todo caso, la disponibilidad de herramientas adecuadas para la detección y desinfección de programas informáticos dañinos. 

The Living Room Coworking, S.L.U. no se responsabiliza de los daños producidos en los equipos informáticos de los usuarios o de terceros durante la prestación del servicio del portal.

4.3 De la disponibilidad del servicio

El acceso al portal requiere de servicios y suministros de terceros, incluidos el transporte a través de redes de telecomunicaciones cuya fiabilidad, calidad, continuidad y funcionamiento no corresponde a The Living Room Coworking, S.L.U. Por consiguiente, los servicios proveídos a través del portal pueden ser suspendidos, cancelados o resultar inaccesibles, con carácter previo o simultáneo a la prestación del servicio del portal. 

The Living Room Coworking, S.L.U. no se responsabiliza de los daños o perjuicios de cualquier tipo producidos en el usuario que traigan causa de fallos o desconexiones en las redes de telecomunicaciones que produzcan la suspensión, cancelación o interrupción del servicio del portal durante la prestación del mismo o con carácter previo.

4.4 De los contenidos y servicios enlazados a través del portal

El servicio de acceso al portal incluye dispositivos técnicos de enlace, directorios e incluso instrumentos de búsqueda que permiten al usuario acceder a otras páginas y portales de Internet (en adelante, ‘sitios enlazados’). En estos casos, The Living Room Coworking, S.L.U. actúa como prestador de servicios de intermediación de conformidad con el artículo 17 de la Ley 34/2002, de 12 de julio, de Servicios de la Sociedad de la Información y el Comercio Electrónico (LSSI) y sólo será responsable de los contenidos y servicios suministrados en los sitios enlazados en la medida en que tenga conocimiento efectivo de la ilicitud y no haya desactivado el enlace con la diligencia debida. En el supuesto de que el usuario considere que existe un sitio enlazado con contenidos ilícitos o inadecuados podrá comunicárselo a The Living Room Coworking, S.L.U. de acuerdo con el procedimiento y los efectos establecidos en la cláusula 6, sin que en ningún caso esta comunicación conlleve la obligación de retirar el correspondiente enlace.

En ningún caso, la existencia de sitios enlazados debe presuponer la existencia de acuerdos con los responsables o titulares de los mismos, ni la recomendación, promoción o identificación de The Living Room Coworking, S.L.U. con las manifestaciones, contenidos o servicios proveídos.

The Living Room Coworking, S.L.U. no conoce los contenidos y servicios de los sitios enlazados y por tanto no se hace responsable por los daños producidos por la ilicitud, calidad, desactualización, indisponibilidad, error e inutilidad de los contenidos y/o servicios de los sitios enlazados ni por cualquier otro daño que no sea directamente imputable a The Living Room Coworking, S.L.U..

6. Comunicación de actividades de carácter ilícito e inadecuado

En el caso de que el usuario o cualquier otro usuario de internet tuvieran conocimiento de que los sitios enlazados remiten a páginas cuyos contenidos o servicios son ilícitos, nocivos, denigrantes, violentos o contrarios a la moral podrá ponerse en contacto con The Living Room Coworking, S.L.U. indicando los siguientes extremos:

2. Descripción de los hechos que revelan el carácter ilícito o inadecuado del sitio enlazado;
3. En el supuesto de violación de derechos, tales como propiedad intelectual e industrial, los datos personales del titular del derecho infringido cuando sea persona distinta del comunicante. 
4. Asimismo deberá aportar el título que acredite la legitimación del titular de los derechos y, en su caso, el de representación para actuar por cuenta del titular cuando sea persona distinta del comunicante;
5. Declaración expresa de que la información contenida en la reclamación es exacta.

La recepción por parte de The Living Room Coworking, S.L.U. de la comunicación prevista en esta cláusula no supondrá, según lo dispuesto en la LSSI, el conocimiento efectivo de las actividades y/o contenidos indicados por el comunicante.

Asimismo deberá aportar el título que acredite la legitimación del titular de los derechos y, en su caso, el de representación para actuar por cuenta del titular cuando sea persona distinta del comunicante; declaración expresa de que la información contenida en la reclamación es exacta.

7. Notificaciones

Todas las notificaciones y comunicaciones realizadas por las partes serán válidas de conformidad con los medios admitidos en derecho. Las relativas al presente portal se considerarán eficaces, a todos los efectos, si se realizan a través del propio portal.

8. Modificaciones

The Living Room Coworking, S.L.U. se reserva el derecho de efectuar sin previo aviso las modificaciones que considere oportunas en su web, pudiendo cambiar, suprimir o añadir tanto los contenidos y servicios que se presten a través de la misma como la forma en la que éstos aparezcan presentados.

Por otro lado, los presentes términos y condiciones podrán cambiar en cualquier momento. Las modificaciones entrarán en vigor desde el momento de su publicación.

The Living Room Coworking, S.L.U. está presente en diversas redes sociales y plataformas, por lo tanto, cuando se accede a cualquiera de estas u otras redes, habrá que tener en cuenta que las condiciones de uso aplicables son las que cada plataforma tiene establecidas, en las cuales, The Living Room Coworking, S.L.U. no interviene.

10. Legislación

El presente aviso legal se rige en todos y cada uno de sus extremos por la ley española siempre y cuando la ley aplicable permita la renuncia al fuero legal establecido, se designa como fuero para dirimir posibles disputas, los juzgados de Málaga, renunciando expresamente el usuario a cualquier otro fuero que pudiera corresponder.
